This Privacy Policy describes how Checkin or Egg, Inc. ("Checkin or Egg," "we", "us" or "our") processes personal information that we collect through our digital properties or services that link to this Privacy Policy (including as applicable, our website, mobile application, social media pages, marketing activities, live events and other activities described in this Privacy Policy (collectively, the "Service")).

Checkin provides a platform to connect individuals via online video chat sessions. This Privacy Policy may not apply to information that we process on behalf of our business customers (such as businesses and other organizations) while providing the Checkin platform to them. Our use of information that we process on behalf of our business customers may be governed by our agreements with such customers. If you have concerns regarding your personal information that we process on behalf of a business customer, please direct your concerns to that enterprise customer.

Personal information we collect

Information you provide to us. Personal information you may provide to us through the Service or otherwise includes:

  1. Contact data, such as your first and last name, email and mailing addresses, residence, postal code, phone number, professional title, and organizational affiliation.
  2. Profile data, such as your username and password that you set to establish an online account with us, age, gender, biographical details, photograph, links to your profiles on various third party sites including social networks, and topic preferences including any health information you choose to provide.
  3. Data about others for whom you schedule a Checkin session, such as the session participant’s full name, phone number, email address, gender, birthday. Please do not schedule a Checkin session for someone or share their contact information with us unless you have their permission to do so.
  4. Communications that we exchange, including when you contact us with questions, feedback, or otherwise.
  5. User-generated content data, such as photos, images, music, videos, comments, questions, messages, works of authorship, and other content or information that you generate, transmit, or otherwise make available on the Service, as well as associated metadata. Metadata includes information on how, when, where and by whom a piece of content was collected and how that content has been formatted or edited. Metadata also includes information that users can add or can have added to their content, such as keywords, geographical or location information, and other similar data.
  6. Transactional data, such as the information needed to complete your orders and/or payments on or through the Service (including name, credit card information, bank account number, billing and shipping information, insurance information), and information about payments to and from you and other details of products or services you have purchased from us.
  7. Marketing data, such as your preferences for receiving communications about our products, activities, events, and publications, and details about how you engage with our communications.
  8. Feedback data, such as the information you share when you complete a survey or provide feedback about your experience with the Services.
  9. Other information that we may collect which is not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Data from other sources. We obtain personal information from other sources, such as:

  1. Members, who can provide ratings and feedback on their session experiences through the Services.
  2. Public sources, such as social media platforms.

Automatic data collection. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your activity over time on our sites and other sites and online services, such as:

  1. Device data, such as your computer or mobile device operating system type and version number, manufacturer and model, browser type, screen resolution, IP address, IP address, unique identifiers, the website you visited before browsing to our website, and general location information such as city, state or geographic area.
  2. Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access.
  3. Precise geolocation data, such as when you authorize our mobile application to access your location.
  4. Communication interaction data, such as your interactions with our email, text or other communications (e.g., whether you open and/or forward emails) - we may do this through use of pixel tags (which are also known as clear GIFs), which may be embedded invisibly in our emails.

Cookies. Some of our automatic data collection is facilitated by:

  1. Cookies, which are text files that websites store on a visitor's device to uniquely identify the visitor's browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently and remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating online advertising.
  2. Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data on your device outside of your browser in connection with specific applications.
  3. Web beacons, also known as pixel tags or clear GIFs, which are typically used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked, typically to compile statistics about usage of websites and the success of marketing campaigns.
  4. Software development kitsor SDKs, which are used to incorporate third party computer code that allows our third party service providers or advertising partners to collect data directly from it for a variety of purposes, including to provide us with analytics regarding the use of the Service, to integrate with social media, add features or functionality to our Service, or to facilitate online advertising.

How we use your personal information

We use your personal information for the following purposes or as otherwise described at the time we collect it:

Service delivery. We use your personal information to:

  1. provide, operate and improve the Service and our business;
  2. personalizing the service, including remembering the devices from which you have previously logged in and remembering your selections and preferences as you navigate the Service;
  3. establish and maintain your user profile on the Service, including allowing users to view profiles of members;
  4. process provider payments and related tax filings;
  5. enable security features of the Service, such as by sending you security codes via email or SMS, and remembering devices from which you have previously logged in;
  6. communicate with you about the Service, including by sending announcements, updates, security alerts, and support and administrative messages;
  7. understand your needs, interests, and preferences, and personalize your experience with the Service and our communications; and
  8. provide support for the Service and respond to your requests, questions and feedback.

Research and development. We may use your personal information for research and development purposes, including to analyze and improve the Service and our business. As part of these activities, we may create aggregated, de-identified or other anonymous data from personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.

Marketing and advertising. We, our service providers, and our third-party advertising partners may collect and use your personal information for marketing and advertising purposes:

  1. Direct marketing. We may send you direct marketing communications, including by email and mail, and may personalize these messages based on your needs and interests. You may opt-out of our marketing communications as described in the Opt-out of marketing section below.
  2. Interest-based advertising. We may contract with service providers and third-party advertising companies and social media companies to display ads on our Service and other sites. These companies may also use cookies and similar technologies to collect information about you (including the device data, online activity data and/or geolocation data described above) over time across our Service and other sites and services or your interaction with our emails, and use that information to serve ads that they think will interest you. These ads are known as "interest-based advertisements." You can learn more about your choices for limiting interest-based advertising, in the Advertising choices section below.
  3. Testimonials. With your consent, we may use your feedback and survey responses to post comments about your experience with the Services on the website, for promotions, or otherwise.

Events, promotions and contests. We may use your personal information to:

  1. administer promotions and contests;
  2. communicate with you about promotions or contests in which you participate; and
  3. contact or market to you after collecting your personal information at an event.

Service improvement and analytics. We may use your personal information to analyze your usage of the Service, improve the Service, improve the rest of our business, help us understand user activity on the Service, including which pages are most and least visited and how visitors move around the Service, as well as user interactions with our emails, and to develop new products and services.

With your consent. In some cases, we may specifically ask for your consent to collect, use or share your personal information, such as when required by law.

Cookies and similar technologies. In addition to the other uses included in this section, we may use the Cookies and similar technologies described above for the following purposes:

  1. Technical operation. To allow the technical operation of the Service.
  2. Functionality. To enhance the performance and functionality of our services.
  3. Advertising. To help our third-party advertising partners collect information about how you use the Service and other online services over time, which they use to show you ads on other online services they believe will interest you and measure how the ads perform.
  4. Analytics. To help us understand user activity on the Service, including which pages are most and least visited and how visitors move around the Service, as well as user interactions with our emails.

Compliance and protection. We may use your personal information to:

  1. comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;
  2. protect our, your or others' rights, privacy, safety or property (including by making and defending legal claims);
  3. audit our internal processes for compliance with legal and contractual requirements and internal policies;
  4. enforce the terms and conditions that govern the Service; and
  5. prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

How we share your personal information

We may share your personal information with the following parties and as otherwise described in this Privacy Policy or at the time of collection:

Affiliates. Our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.

Service providers. Companies and individuals that provide services on our behalf or help us operate the Service or our business (such as IT, hosting, customer relationship management and support, print and mail fulfillment, data management, email delivery, marketing, website analytics, and providers of background, credit, and other screening services).

Video Feedback Technologies. We use third party services provided by VideoAsk that allows us to record feedback videos about users' interactions with the Services. These feedback videos may be posted on member profiles. You can learn more about VideoAsk at https://www.videoask.com/help.

Payment processors. Any payment card information you use to make a purchase on the Service is collected and processed directly by our payment processors, such as Stripe. Stripe may use your payment data in accordance with its privacy policy, https://stripe.com/privacy.

Business customers. If you are using the Service in connection with or are otherwise affiliated with one of our business customers, we may share information about your use of the Service with that business customer. Please note that we only share general information about your use of the service (such as whether you attended a Checkin session, with whom, and the length of the session) and we do not share details about the content or discussions that occurred within your session.

Advertising partners. Third party advertising companies that collect information about your activity on the Site and other online services to help us advertise our services, and/or use hashed customer lists that we share with them to deliver ads to them and similar users on their platforms.

Professional advisors. Professional advisors, such as lawyers, auditors and insurers, where necessary in the course of the professional services that they render to us.

Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and operations purposes described above.

Business transferees. Relevant participants in business transactions (or potential transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Checkin or Egg or our affiliates (including, in connection with a bankruptcy or similar proceedings).

Other users and the public. Your user-generated content data may be visible to other users of the Service and the public. For example, other users of the Service or the public may have access to your information if you chose to make available to them through the Service, such as when you provide comments, reviews, survey responses, or share other content. This information can be seen, collected and used by others, including being cached, copied, screen captured or stored elsewhere by others (e.g., search engines), and we are not responsible for any such use of this information.

Your choices

You have the following choices with respect to your personal information.

Access or update your Information. If you have registered for an account with us, you may review and update certain account information by logging into the account.

Opt-out of communications. You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us. You may continue to receive service-related and other non-marketing emails. If you receive text messages from us, you may opt out of receiving further marketing text messages from us by replying STOP to our marketing message.

Cookies. Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Service and our Site may not work properly. Blocking images/clear gifs. Most browsers and devices allow you to configure your device to prevent images from loading. To do this, follow the instructions in your particular browser or device settings.

Privacy settings and location data. Users of our App can disable our access to their device’s precise geolocation in their mobile device settings.

Advertising choices. You may be able to limit use of your information for interest-based advertising through the following settings/options/tools:

  1. Browser settings. Changing your internet web browser settings to block third-party cookies.
  2. Privacy browsers/plug-ins. Using privacy browsers and/or ad-blocking browser plug-ins that let you block tracking technologies.
  3. Platform settings. Google and Facebook offer opt-out features that let you opt-out of use of your information for interest-based advertising. You may be able to exercise that option at the following websites:

  5. Mobile settings. Using your mobile device settings to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.

You will need to apply these opt-out settings on each device and browser from which you wish to limit the use of your information for interest-based advertising purposes.

We cannot offer any assurances as to whether the companies we work with participate in the opt-out programs described above.

Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

Declining to provide information. We need to collect personal information to provide certain services. If you do not provide the information requested, we may not be able to provide those services.

Other sites and services

The Service may contain links to websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages, mobile applications or other online services that are not associated with us. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions.

Security

We employ a number of technical, organizational and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information.

International data transfer

We are headquartered in the United States and may use service providers that operate in other countries. Your personal information may be transferred to the United States or other locations where privacy laws may not be as protective as those in your state, province, or country.

Children

The Service is not intended for use by children under 18 years of age. If we learn that we have collected personal information from a child under 18 without the consent of the child's parent or guardian as required by law, we will delete it.

Session Replay Technologies

We use third party services provided by Hotjar that employ software code to record users' interactions with the Services in a manner that allows us to watch DVR-like replays of those user sessions. The replays include users' clicks, mobile app touches, mouse movements, scrolls and keystrokes/key touches during those sessions. All content contained in the replays is redacted.

Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service. If required by law we will also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via email or another manner through the Service. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your continued use of the Service after the posting of any modified Privacy Policy indicates your acceptance of the modified Privacy Policy.
